About the Summit
The era of enhanced FERC enforcement has begun—and an effective compliance system is your best defense against the wave of actions regarding both alleged energy trading and electric reliability violations. Energy trading enforcement actions include Amaranth receiving over $200M in penalties, and others potentially in line to get hit for an additional $150M or more. Sanctions under the mandatory NERC reliability regulations are being issued to numerous entities, many of which would not have been subject to such oversight in the past. Over 100 matters related to energy markets are under investigation, and only a portion of NERC jurisdictional entities have been audited to date. However, having a demonstrated compliance program and a serious commitment to it has been cited as a mitigating factor in many of the actions in this first wave of enforcement.
